I attained mine two years ago relating to my deceased mother. I’ve worked in the medical malpractice/NH neglect field so I knew all about the importance. Unless I’m wrong, they keep them for 10 years before destroyed. Not a nurse but I can read! So much satanic care was given that the workers just tuned it all out! I bet they are concerned now! They should be. An avalanche of litigation is coming and they will be named “defendant” in millions of cases and boy oh boy the DISCOVERY!
The hospital will not release the records to me for my father. I don't have a relationship with his wife. I'm the administrator to his estate as we are dealing with probate. How else can I obtain the records?
I am confused a little. You are the administrator of the estate. Oddly enough I found out that the hospitals in Ohio won't release to anyone but the representative of the estate. Forcing the opening of a non existent estate, at an average cost of $1500, simply to get records. Have you approached the hospital with all of the documents I listed plus your letters of administration? If so have you approached the HIPAA officer, either in the hospital or the state/county? Are they specifying only the spouse regardless of the estate? I will watch this thread because I really want to know how they are doing it. I know that early on CMS waived away rights to records, but I would think your administrative letters supercede spousal rights. But I am NOT an attorney. Hopefully you won't have to go that route.
My father was killed in a CA hospital. They said that his wife is the only one who can obtain the records. I have emailed my attorney to see if he can help me obtain the records. I had to go through probate to get administrator rights to the estate. Hopefully my attorney can help. I hope to one day get justice for my father and absolutely need those medical records to do so.

Your Atty can help and if he doesn’t contact another one. I think this feds group has or may know entities that have those legal connections.
